Cox confirms internet speed to my house is 50mb, but I only get 30mb.

Hey everyone,

I'm having a problem with my internet speed, hopefully someone can help.  I recently upgraded my modem to a Cisco DPC3010 DOCSIS 3.0 cable modem.  I have premier internet so this should bring my speeds to ~50mb, It currently goes 30mb still with this new modem attached.  I called Cox, gave them my new MAC address, and they confirmed over the phone that from their end I'm getting 50mb.

They then sent a tech rep out to my house and he hooked up some hardware to my modem and confirmed that it's going 50mb. I'm on a wired connection and I have a router but for my tests I plugged the cable modem directly into the computer to rule out a router issue.  The rep confirmed my speeds are correct but it's still going 30mb in speed tests.  I'm running Windows 8.1 so to rule that out I booted from Linux and I get the same speed, 30mb.

So after all the tests here's where I'm at:

1. my modem, cables and network adapter are working correctly.  My modem levels are all within the correct range.

2. my speed from Cox is working correctly and is 50mb at the modem

3. when I run speed tests from the Internet I only get 30mb

4. I have 3 ethernet adapters, I've tried them all, so I don't think it's a hardware problem with one of them.

5. I reset the modem several times which did not help.

Has anyone had this issue and can you suggest what I should do to fix it?  Does this modem need a firmware update perhaps?  I bought it new, and it is going 50mb coming out of the modem so right now I'm at a loss what to check next.
